1. Acceptance of Terms

By accessing or using the CakeMate platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and CakeMate.

2. Description of Service

CakeMate is a cloud-based bakery management platform that provides tools for 3D cake design, order management, inventory tracking, customer management, and ingredient calculations. The Service is provided on a subscription basis with free and paid tiers.

3. User Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • You may not share your account with others or allow multiple individuals to use a single account (team features are available on applicable plans).

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorised access to any part of the Service.
  • Interfere with or disrupt the Service or servers.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated tools to scrape data from the Service without permission.

5. Subscription & Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis.
  • You may cancel at any time; access continues until the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice.
  • All fees are quoted in Euros (€) unless otherwise stated.

6. Intellectual Property

The Service, including its design, code, features, and content, is owned by CakeMate and protected by intellectual property laws. You retain ownership of any business data you enter into the platform. By using the Service, you grant us a limited licence to store and process your data solely to provide the Service.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We take data protection seriously and comply with applicable data protection regulations, including GDPR.

8. Limitation of Liability

To the maximum extent permitted by law, CakeMate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

10. Termination

We may suspend or terminate your access if you violate these Terms. Upon termination, you may export your data within 30 days. After that period, we may delete your account and associated data.

11. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be resolved in the courts of Dublin, Ireland, unless applicable consumer protection laws require otherwise.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance.
